In January 2022, the Ukrainian government approved the bill “On Amendments to the Law of Ukraine “On Immigration”. The draft law provides for the improvement of immigration permitting mechanisms, in particular, the simplification of the procedure for granting immigration permits to foreign highly qualified IT professionals. First of all, the processing time for obtaining immigration permits by this category of applicants is supposed to be reduced from one year to six months.

Earlier, in 2021 the Government of Ukraine simplified the conditions for obtaining a permanent residence permit for foreign IT professionals. In particular, the quotas were increased, the list of professions and qualification requirements were revised.

On January 19, 2022, new immigration quotas for 2022 year were approved by the Cabinet of Ministers of Ukraine.

To obtain an immigration permit and a permanent residence permit an applicant needs to take the following steps:

  1. To provide the documents confirming affiliation to one of the professions and compliance with the qualification requirements stipulated by the Order of the Ministry of Economy, Trade and Agriculture of Ukraine of 6 January 2021.
  2. To collect the remaining necessary documents. In particular, a certificate of no criminal record and a medical certificate. The full list of documents is available on the website of the State Migration Service of Ukraine.
  3. The collected documents and the application for an immigration permit should be submitted to the relevant diplomatic mission of Ukraine at the place of residence abroad or to a subdivision of the State Migration Service at the place of residence in Ukraine. As a rule, the application process takes 3-4 months, although by law it can take up to 1 year.

In case of a positive decision, the IT specialist obtains an immigration permit to Ukraine valid for 1 year. That is, a foreigner can come to Ukraine within 1 year from the date of issuance of an immigration permit, and on the basis of this permit to obtain a permanent residence permit within 2-3 weeks.

As a holder of Ukrainian permanent residence permit a foreigner has the right to:

  • be employed in Ukraine on the same conditions as citizens of Ukraine without obtaining a work permit;
  • cross the border of Ukraine unlimited number of times without visas;
  • obtain an immigration permit for family members (spouse and minor children).

A permanent residence permit is issued for 10 years and can be renewed after the expiration date.
