What happens if a foreigner has overstayed?

There was no fine or other penalty for overstaying during the first wave of quarantine (from March 12th, 2020 till August, 2021) + 30 days after the date of quarantine cancellation.

But the situation has changed recently. From August 7th, 2021, foreigners who have violated migration legislation will again be subject to administrative measures, including fines. According to article 203 of the Code of Administrative Offenses of Ukraine, the foreigner will be fined UAH 1700-5100 (around USD 60-200) for it. It is possible to pay the fine right at the border control or in advance at a local office of the State Migration Service of Ukraine.

The details about any overstaying is easily checked by the authorities at the border control.

The overstay is not cancelled by the fine, therefore, the foreigner will have to wait 90 days before re-entering Ukraine.

Our lawyers can help to check if there are such barriers before submitting documents for obtaining a residence permit. Our lawyers can help you to pay any fine in advance so as not to have unpleasant delays during departure.

We also remind you that in case a foreigner has any unpaid fines in Ukraine (including traffic fines) while applying for a residence permit the State Migration Service may deny the application.
